Acceptance of terms
By accessing or using helium, you agree to be bound by these Terms of Service and any plan-specific order form your organization has signed with us.
Description of service
helium provides competitive intelligence and media planning tools that surface competitor spend, casting, and performance signal for creator marketing teams. Features and data coverage vary by plan.
Accounts
You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
Acceptable use
You agree not to resell, sublicense, or redistribute helium's data or output outside your organization without our written consent, and not to use the service to build a competing product.
Subscription & payment
Paid plans are billed in advance on a monthly or annual basis as set out in your order form. Fees are non-refundable except as required by law or expressly stated otherwise.
Intellectual property
helium and its underlying technology remain our property. You retain ownership of any data or content you upload; you grant us a license to process it solely to provide the service.
Disclaimer of warranties
helium is provided "as is." Competitive signal is aggregated from public and licensed sources and is provided for planning purposes — we don't guarantee its completeness or accuracy for any specific business decision.
Limitation of liability
To the maximum extent permitted by law, helium is not liable for indirect, incidental, or consequential damages arising from use of the service.
Termination
Either party may terminate for convenience at the end of the applicable subscription term, or immediately for material breach that isn't cured within a reasonable period.
Governing law
These terms are governed by the laws of the jurisdiction specified in your order form, without regard to conflict-of-law principles.
Changes to these terms
We may update these terms from time to time. Material changes will be communicated to active customers before taking effect.
